On this article, it is addressed the companies’ duty of developing a digital disconnection policy, complying with the Regulation (EU) 2016/679, on the protection of natural persons and article 88 of the Organic Law 3/2018, of 5 December, on personal data protection.
Portugal - New changes to the Portuguese Labour Code
After the teleworking regime has been substantially amended at the beginning of 2022, the Portuguese Labour Code will be amended once again.
These modification, which are expected to be approved by the Council of Ministers in June 2022, come from a set of legislative measures concerning decent work (in the scope of the Decent Work Agenda and the Valorisation of Young People in the Labour Market) and aim to meet the labour goals that are considered priorities by the Government regarding the challenges identified since the beginning of the Covid-19 pandemic. They may become effective during 2022, but this is not certain yet.
According to the information provided by the area of Labour, Solidarity and Social Security, the areas that will be mostly affected by such measures are:
(i) temporary work
(ii) combating false self-employment and unjustified use of non-permanent work
(iii) work-life balance
(iv) protection of young working students and trainees
(v) protection of informal caregivers
(vi) reinforcement of the fight against undeclared work
(vii) reinforcing the powers of Authority for Working Conditions
(viii) collective bargaining;
(ix) digital platforms and algorithms
