On 1 June 2023, the new Unitary Patent (UP) system will come into force allowing applicants to obtain uniform patent protection within the 25 EU Member States by filing a single application with the European Patent Office (EPO).

Spain - The Supreme Court declares that dismissal for non-reinstatement after IT exhaustion is fair
 
A recent Supreme Court ruling is analyzed, which determines that, in the processes of TI due to common contingencies, medical discharge issued within 365 days obliges reincorporation into the workplace, the failure to reincorporate being unjustified.

Spain - Can the failure to challenge a document in a proceeding be qualified as professional negligence?
 
We will study whether the failure to challenge a document by the professional in charge of the lawsuit at the preliminary hearing may constitute professional negligence that must be compensated.
To do so, we will analyze the criterion maintained by the Barcelona Provincial Court in its ruling of 16.12.2020, which resolves an appeal.
